PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE. BY ACCESSING AND USING THE SITE IN ANY WAY — INCLUDING BROWSING, USING ANY INFORMATION, CONTENT, OR SERVICES, DOWNLOADING ANY SOFTWARE OR FILES, OR PLACING ORDERS FOR PRODUCTS — YOU AGREE TO BE BOUND BY THESE TERMS. 1. Definitions

  • "FastTrek Website" or "Website" means any website that is the property of FastTrek LLP, including but not limited to everything hosted under the domain fasttrek.space.
  • "Site" means, collectively, our Website and any products or services made available through it.
  • "FastTrek" or "we" means FastTrek LLP, a limited liability partnership registered in England and Wales (No. OC448350), with its registered office at 14 Acorn Place, Castleton, Cardiff, CF3 2WE, United Kingdom.

Via the Website, FastTrek makes a number of resources available to you, including information, software, product downloads, documents, communications, text, graphics, publications, and tools.

2. Acceptance of Terms

By accessing or using our Website, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), or that you have the consent of a parent or legal guardian, and that you have the legal capacity to enter into these Terms. If you are using the Website on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Your continued use of the Website after changes to these Terms have been posted constitutes your acceptance of those changes.

3. Changes to These Terms

FastTrek reserves the right, at its sole discretion, to change, add, or remove any part of these Terms at any time without prior notice. We may, at our discretion, notify those subscribed to our communications channels. However, it is your responsibility to review these Terms periodically. We will update the "Last updated" date above when changes are made.

4. Acceptable Use

In using the Website, including all software, services, and resources available through it, you agree that:

  1. You will not use the Website in any way that could damage, disable, overburden, or impair any FastTrek server, or the network(s) connected to any FastTrek server, or interfere with any other visitor's use and enjoyment of the Website.
  2. You will not upload, email, or otherwise transmit via the Website any potentially destructive, disruptive, or otherwise harmful programs, files, or code, including viruses, Trojan horses, worms, or any other form of files or programs that may damage or alter the operation of a computer or network.
  3. You will not attempt to disrupt or interfere with the security, integrity, or availability of the Website, its content, or any resources provided for visitors, including user accounts, passwords, and servers.
  4. You will not attempt to gain unauthorised access to services, materials, visitor information, computer systems, or networks connected to any FastTrek server, through hacking, password mining, or any other means.
  5. You will not use false identity information when registering for subscriptions, downloads, or product licences.
  6. You will not remotely harvest or otherwise collect information about others, including email addresses, nor will you use email addresses published on the Website to send any type of unsolicited communication with disguised or falsified origins.
  7. You will not use the Website for any illegal, fraudulent, or harmful purpose.
  8. You will not use automated means (scrapers, crawlers, bots, or data-mining tools) to access the Website without our express permission. This includes cryptocurrency-mining or other automated processes.
  9. You will not resell or redistribute any content, services, or access to the Website without authorisation.

5. International Access

The Website can be accessed from most countries around the world. Content may contain references to FastTrek products, services, or promotions that are not available in your country. These references do not imply that FastTrek intends to make such resources available in your country.

FastTrek makes no representation that the Website or any resources available through it are appropriate for or available in any particular locality. If the Website or any of the resources it makes available are illegal in your locality, do not use the Website. In the event of a conflict between these Terms and a mandatory provision of applicable law, the mandatory provision shall prevail.

6. Website Content

Unless specifically indicated elsewhere on the Website, you may view, download, and print Website content subject to the following conditions:

  1. The rights granted to you constitute a licence and not a transfer of title.
  2. You may use Website content only for non-commercial purposes or in order to purchase our products.

  4. You may not modify or alter Website content in any way.
  5. You may not distribute, sell, lease, rent, or sub-licence Website content to others.
  6. FastTrek reserves the right to revoke authorisation to view, download, print, or otherwise use Website content at any time, and you shall discontinue such use immediately upon notice.

7. Uploading Content

As part of the Website's functionality, FastTrek may provide you with the option to upload data for further use, including in the provision of support for FastTrek products and services. Without FastTrek's written permission, you may not:

  1. Upload data other than as requested or required by FastTrek.
  2. Upload data containing computer viruses, worms, malware, data restricted by legislation, or data otherwise containing anything of a malicious nature.
  3. Upload any files which could cause harm to FastTrek, the Website, customers, facilities, or equipment.
  4. Post comments, participate in forums or community discussions, or otherwise use the Website in a manner inconsistent with these Terms.

If you choose to post a comment or other content publicly, your username and any other information you choose to include will be visible to the public. FastTrek is neither responsible nor liable for the privacy of any information that you choose to post publicly. Any information that you disclose publicly becomes public information.

8. Use of Software

The software and accompanying documentation available for download from the Website is the copyrighted work of FastTrek and/or its suppliers. Use of any FastTrek software is governed by the FastTrek User Agreement. You will not be able to install or access any software that is subject to a subscription agreement unless you agree to the terms of that agreement.

If no other agreement governs the use of particular software, then these Terms of Service shall apply. You agree that you will not decompile, reverse-engineer, or otherwise attempt to discover the source code of the software available on the Website, unless applicable law specifically authorises you to do so.

9. Intellectual Property and Trademarks

Website content, including software and related documentation as well as the structure of the Website, is protected by copyright, trademark, patent, and/or other intellectual property laws. Unauthorised use of Website content may violate such laws and these Terms.

Except as expressly stated in this document, FastTrek and its suppliers do not grant any express or implied rights to use Website content. You agree not to copy, republish, embed, download, transmit, modify, rent, lease, loan, sell, assign, distribute, licence, sublicence, reverse-engineer, or create derivative works based on the Website and/or its content, except as expressly authorised.

Trademarks

The names, trademarks, logos, icons, and other distinctive features ("Marks") displayed on the Site are the property of FastTrek or third parties. You may not use Marks without the prior written consent of FastTrek or the relevant third-party owner. You may use FastTrek logos under these conditions:

  1. You may not alter the logos in any way except for proportional resizing.
  2. You may not hotlink directly to the logo image files on the Site.
  3. You may not use the logos in any manner that represents or implies any affiliation with or endorsement by FastTrek unless formally established in writing.

FastTrek reserves the right to determine what constitutes improper use of its Marks and logos, and you agree to correct or cease such use upon notification.

10. Third-Party Services and Links

The Website may contain links to other external (non-FastTrek) websites and services. FastTrek is not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is at your own risk. We encourage you to review the privacy policies and terms of use of any third-party site you visit.

11. Data Processing on the Website

In connection with your use of the Website, FastTrek and its associated companies may process your personal data. For full details of our data practices, please refer to our Privacy Policy. A summary of the purposes for which we process personal data in connection with the Website is as follows:

  1. To provide you with software, services, or information;
  2. To protect FastTrek from piracy and unlawful use of its software or services;
  3. To improve FastTrek offerings based on usage;
  4. For our internal records and to protect the rights and interests of FastTrek and other users;
  5. To promote and market FastTrek software and services (with your consent where required);
  6. To provide third parties with aggregated, anonymised information about use of the Website;
  7. To fulfil legal duties stipulated by accounting, taxation, and other laws.

You may object to the processing of your personal data for purposes (b) to (e) at any time by emailing privacy@fasttrek.space. You may also withdraw consent where processing is based on consent, without affecting the lawfulness of any processing that occurred before withdrawal.

12. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, SERVICES, AND RESOURCES AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER THE CONSUMER RIGHTS ACT 2015 (UK) OR MANDATORY CONSUMER PROTECTION REGULATIONS IN YOUR JURISDICTION.

If you are a consumer, you may have mandatory statutory rights in relation to defective products, including rights to repair or an appropriate price reduction. These statutory rights are described in Section 7.1 of the Purchase Terms and are not affected by the disclaimers in this section.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTTREK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE GREATER OF (A) TEN (10) US DOLLARS OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless FastTrek and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Website, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without reference to conflict of laws principles and specifically excluding the United Nations Convention on Contracts for the International Sale of Goods.

The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms. However, if you are a consumer habitually resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights to rely on any mandatory provisions of the law of your country of habitual residence.

If you are a consumer in the EU, you may also make use of the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. General Provisions

  • Entire Agreement: These Terms, together with the FastTrek User Agreement, the Purchase Terms, and the Privacy Policy, constitute the entire agreement between you and FastTrek regarding use of the Website.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. FastTrek may assign its rights and obligations under these Terms without restriction.
  • Force Majeure: Neither party shall be in breach of these Terms by reason of any delay or non-performance of any obligation (except payment obligations) arising from circumstances beyond its reasonable control, including natural disaster, act of terrorism, pandemic, strike, riot, or act of war.
